Refunds/Cancellations Policy


These Terms of Use govern the relationship between Happy Gaana Entertainment Pvt. Ltd. (Happydemic), a company registered under the laws of India having its registered office at 301 Narain Chambers, M.G. Road, Vile Parle (East), Mumbai 400057 (hereinafter referred to as "the Company," "We," "Us," or "Our") and the persons who use the platform titled ‘Songstruck’ provided on the Happydemic website (hereinafter referred to as "You," "Your," "Yourself," or "User," "Users," or "Customer").

This Cancellation and Refund Policy applies to all Users booking a Private Concert through the ‘Songstruck’ platform.

This Cancellation and Refund Policy shall be read in accordance with the User Terms. The terms as have been defined in the User Terms and Privacy Policy shall have the same meaning and effect in this Cancellation and Refund Policy.

By making a Booking, You agree to the Cancellation and Refund terms outlined below.


1. Cancellation of Booking and Refunds

A Booking can be canceled either by the Company or You.

1.1 Cancellation by the Company:

In the event the Company cancels the Booking, the following will apply:

  1. Refund: You will be entitled to a full refund of the total Fees paid.

  2. Refund Process: The refund will be processed and initiated by the Company within 7 (seven) working days from the Company's confirmation of the cancellation. The refund will be credited to the original payment method used for the Booking or any other method as communicated by the Company.

  3. User’s acknowledgment: You understand, acknowledge and accept that the Company is not responsible in the event

    1. The booking is cancelled for any reason and at any time whatsoever or any loss or damage accruing to you owing to such cancellation
    2. You enter the incorrect details (i.e. date, time, city) for your Request for Booking and thereafter confirm such a Booking.
    3. Of a Force Majeure Events or any losses or damages arising out of the same.
    4. Any misbehavior or untoward actions, misrepresentation, fraudulent act or omission, negligence or default by the Artist at the time of performance and any liability, losses or damages arising owing to such act or omission.

1.2 Cancellation by the User:

You may cancel Your Booking at any time for any reason whatsoever. However, cancellation fees may apply, as per the schedule in 1.2.2 below:

1.2.1 Cancellation Procedure:

  1. Notification: To cancel your Booking, You must send an email to songstruck@happydemic.com with the following details:
    • Booking reference number
    • Private Concert Date
    • Artist Name (if any)
    • Total amount paid
  2. Acknowledgement: Upon receipt of Your cancellation request, the Company will acknowledge Your request via an automatic email response.

1.2.2 Cancellation Penalty and Refund Schedule:

The following penalty fees will apply based on the timing of Your cancellation:

  1. Cancellation 72 (seventy-two) hours before the Private Concert:
    If You cancel Your Booking 72 (seventy-two) hours before the Private Concert, You will be entitled to a refund of 50% of the total Fees paid. A 50% cancellation fee will be deducted.
  2. Cancellation Within 72 (seventy-two) hours of the Private Concert:
    If You cancel Your Booking within 72 (seventy-two) hours of the Private Concert, You will not be entitled to any refund, and the entire Fees will be retained by the Company as a cancellation penalty.

1.3 No-Show by Artist:

If the Artist fails to attend or perform at the scheduled Private Concert without prior notice, You will be entitled to a 100% refund of the total Fees. The refund process will be initiated by the Company within 7 days of the Private Concert date.


2. Refund Process

The Company will notify You of the total amount refundable, the mode of payment, and the expected date by which You can expect the refund through email.

2.1 Payment Mode: Refunds will be processed manually by the Company and will not be processed through any Payment Gateway.

2.2 Cheque Refunds: All refunds will be made via cheque. The cheque will be sent to the address provided in Your government-authorized identity card submitted while making the Booking.

2.3 Processing Time: Once a refund is initiated, you can expect to receive it within 7-14 business days, depending on the postal service or as otherwise communicated by the Company.


3. Changes or Postponements of Private Concert

3.1 Rescheduling:

In the event the Company requests to reschedule the Private Concert, You will be notified by the Company and offered the following options:

  1. Accept the rescheduled date: You can choose to accept the new date proposed by the Company.
  2. Full Refund: If You do not wish to accept the new date, You are entitled to a full refund of the Fees paid.

3.2 Rescheduling by You:

  1. If You wish to reschedule the Private Concert, You must notify the Company at least 72 (seventy-two) hours prior to the Private Concert date. The Company and the Artist will make efforts to accommodate your request, but this is subject to the Artist’s availability.
  2. In the event the new date is not available, You may choose to cancel the Booking, and the refund will be processed as per the cancellation terms outlined above.
  3. You may reschedule the Private Concert event only once. Any further requests for rescheduling will not be accepted, and cancellation terms outlined above will apply.


4. Force Majeure Events

The Company will not be liable for any failure to fulfill the booking due to Force Majeure Events.

In the event of a Force Majeure Event, both the Company and You are entitled to cancel or reschedule the Booking without penalty. The Company will facilitate communication between both parties to reach a mutually agreeable solution.

The Company reserves the right to make the final decision on all refund and cancellation matters.
